1. Introduction

1.1

These Terms & Conditions of Sale (“Terms”) apply to all quotations, orders, sales and supplies of goods made by Fun in a Box Limited (Company Number 06494767), registered in England and Wales, trading as:

  • Personalised Printed Ribbons
  • Car Bows
  • Door Bows
  • Racing Car Party
  • Fun Party Supplies

Throughout these Terms, “we”, “us” and “our” refer to Fun in a Box Limited.

The words “you” and “your” refer to the customer placing an order with us.

1.2

These Terms apply whether you purchase as:

  • a consumer;
  • a sole trader;
  • a partnership;
  • a limited company;
  • a charity;
  • a school;
  • a public sector organisation; or
  • any other business or organisation.

Where different legal rights apply to consumers and business customers, this is made clear within these Terms.

By placing an order through any of our websites, by telephone, by email or by any other method, you confirm that you have read, understood and accepted these Terms.

2. About Us

Fun in a Box Limited is a UK family business that has specialised in personalised ribbons, handcrafted bows and celebration products since 2007.

We manufacture many of our products in-house from our workshop in Essex and also work with carefully selected specialist manufacturing partners where particular production methods or finishes are required.

Our aim is simple:

To provide high-quality personalised products with friendly advice, reliable service and excellent value.

4. Definitions

Within these Terms the following definitions apply.

Artwork

Any logo, text, image, design, photograph, QR code, barcode, font or other material supplied by you or created on your behalf.

Business Customer

Any customer purchasing goods wholly or mainly for business, commercial, professional, educational, charitable or organisational purposes.

Consumer

An individual acting wholly or mainly outside their trade, business, craft or profession.

Goods

Any products supplied by Fun in a Box Limited, including but not limited to:

  • personalised ribbon
  • plain ribbon
  • bows
  • ceremonial products
  • car bows
  • door bows
  • scissors
  • packaging products
  • accessories
  • party supplies
  • balloons
  • decorations

Personalised Goods

Goods manufactured or customised specifically to your individual requirements.

This includes products featuring:

  • names
  • wording
  • logos
  • colours
  • artwork
  • bespoke sizing
  • bespoke manufacture

or any other customisation requested by you.

Working Day

Monday to Friday excluding public holidays in England.

5. Ordering

5.1

Orders may be placed:

  • through our websites
  • by email
  • by telephone
  • by quotation acceptance
  • by any other method agreed by us.

5.2

When placing an order, you are responsible for ensuring that all information supplied is accurate, including:

  • delivery address
  • billing details
  • spelling
  • names
  • dates
  • telephone numbers
  • email addresses
  • artwork
  • ribbon colours
  • ribbon widths
  • quantities
  • product selections

We cannot accept responsibility for delays or additional costs resulting from incorrect information supplied by you.

5.3

An order shall not be considered accepted until:

  • payment has been received (unless otherwise agreed in writing); and
  • we have confirmed acceptance of the order.

5.4

We reserve the right to decline any order where:

  • artwork may infringe intellectual property rights;
  • abusive or offensive material has been supplied;
  • production is not technically possible;
  • stock or materials are unavailable;
  • pricing errors have occurred; or
  • we reasonably believe we are unable to fulfil the order to our usual standards.

Should this occur, any payment already received will be refunded.

6. Prices

6.1

Unless otherwise stated, all prices displayed on Personalised Printed Ribbons are shown exclusive of UK VAT.

VAT will be added at the prevailing rate where applicable during checkout.

6.2

Delivery charges are shown separately during the checkout process unless otherwise stated.

6.3

Whilst every effort is made to ensure prices are accurate, errors may occasionally occur.

If an obvious pricing error is identified after an order has been placed, we reserve the right to cancel the order before production begins.

Where this happens, you will be offered either:

  • a full refund; or
  • the opportunity to proceed at the correct price.

7. Payment

7.1

Payment is required before production commences unless otherwise agreed by us in writing.

We do not currently offer trade credit facilities.

7.2

We accept payment by major UK credit and debit cards, PayPal and BACS bank transfer.

Available payment methods may change from time to time.

7.3

Ownership of all goods remains with Fun in a Box Limited until payment has been received in full.

8. Artwork

8.1

By supplying artwork to us, you confirm that:

  • you own the intellectual property rights; or
  • you have obtained permission from the copyright owner; or
  • you otherwise have lawful authority to authorise reproduction.

This applies to all supplied content including:

  • logos
  • trademarks
  • photographs
  • illustrations
  • fonts
  • QR codes
  • AI-generated artwork
  • graphics
  • text

8.2

You agree to indemnify Fun in a Box Limited against any claim arising from the reproduction of artwork supplied by you.

8.3

We reserve the right to refuse artwork where we reasonably believe production could infringe copyright, trademark or other intellectual property rights.

8.4

Minor adjustments may occasionally be necessary to improve print quality or production efficiency.

Examples include:

  • resizing artwork;
  • adjusting spacing;
  • repositioning elements;
  • simplifying fine detail where technically required.

Such amendments will always be reflected within your artwork proof wherever practical.

9. PDF Artwork Proofs

One of the things that makes us different is that we want you to be completely happy before production begins.

For this reason, unless clearly identified as a repeat order using previously approved artwork, personalised orders include a digital PDF artwork proof.

9.1

Production will not normally begin until the artwork proof has been approved.

9.2

It is your responsibility to carefully check every aspect of the proof, including but not limited to:

  • spelling;
  • grammar;
  • punctuation;
  • dates;
  • telephone numbers;
  • website addresses;
  • email addresses;
  • logo placement;
  • ribbon colour selections;
  • print colour selections;
  • ribbon width;
  • layout;
  • spacing.

9.3

Once a proof has been approved, you accept responsibility for any errors contained within that approved artwork.

Fun in a Box Limited cannot accept responsibility for mistakes which were present on an approved proof.

9.4

Delays in approving artwork proofs will delay production and dispatch.

Estimated lead times begin only after final artwork approval has been received.

9.5

If artwork has been prepared at your request and you subsequently cancel your order before production begins, we reserve the right to make a reasonable charge for design time already undertaken where this has been made clear before work commenced.

10. Colour Accuracy

Producing beautiful personalised ribbon is both a technical and creative process.

Whilst we make every effort to achieve consistent, high-quality results, exact colour reproduction cannot always be guaranteed.

10.1

Ribbon colours displayed on screens are intended as a guide only.

Colours may appear different depending upon:

  • monitor calibration;
  • mobile phone displays;
  • tablet displays;
  • browser settings;
  • ambient lighting;
  • photography.

10.2

Ribbon dye batches naturally vary between manufacturing runs.

Whilst we work closely with trusted suppliers to maintain consistency, slight shade variations are an accepted characteristic of textile production.

10.3

Metallic foils naturally reflect surrounding light.

Gold, silver and other metallic finishes may appear lighter, darker or warmer depending upon lighting conditions and viewing angle.

This is a normal characteristic of metallic foil printing and not a manufacturing fault.

10.4

The same print colour may appear different when applied to different ribbon colours due to the underlying ribbon colour influencing the overall appearance.

10.5

Where exact colour matching is essential, we strongly recommend ordering samples before placing larger production orders.

10.6

Customers requesting Pantone matching or specialist colour services should be aware that some variation may still occur due to differences between inks, foils, ribbons and textile materials.

11. Production

11.1

Many of our products are manufactured, printed or assembled specifically to your order. Production methods vary depending on the product selected and may include in-house manufacture together with specialist UK or international production partners.

11.2

Estimated production times shown on our website, quotations or correspondence are provided as a guide only and commence only after:

  • payment has been received (unless otherwise agreed);
  • all artwork has been approved;
  • all required information has been supplied;
  • any requested clarification has been received.

11.3

Where an order contains a mixture of products with different production lead times, we may dispatch the complete order together unless otherwise agreed.

11.4

We reserve the right to alter production methods where this allows us to maintain product quality or delivery times without materially affecting the finished product.

11.5

Whilst every effort is made to complete orders within estimated lead times, production schedules may occasionally be affected by circumstances beyond our reasonable control, including supplier delays, equipment maintenance or unusually high demand.

12. Handmade Products

Many of our bows and decorative products are individually handmade by experienced members of our production team.

This is one of the characteristics that makes each product unique.

12.1

As a result of their handmade nature, slight variations may occur between individual products, including:

  • loop size;
  • bow shape;
  • knot size;
  • ribbon tails;
  • folding;
  • overall appearance.

These variations are considered normal and are not defects.

12.2

Product photographs are intended to represent the style and quality of the finished item.

As many products are handmade, the item supplied may differ slightly from photographs displayed on our website.

12.3

From time to time we may make small improvements to our products, including changes to construction methods, internal supports, knot design or finishing techniques, without prior notice.

These improvements are intended to enhance quality, durability or presentation and shall not be regarded as material changes to the product.

13. Suitability of Products

13.1

It is your responsibility to ensure that the products ordered are suitable for their intended purpose.

This includes selecting the appropriate:

  • ribbon width;
  • ribbon material;
  • ribbon colour;
  • print method;
  • quantity;
  • bow size;
  • product finish.

13.2

We are always pleased to provide guidance before you place an order.

However, unless we have expressly confirmed suitability in writing, responsibility for the final product selection remains with the customer.

13.3

Where products are being used for specialist applications, commercial promotions, outdoor installations, manufacturing processes or any unusual purpose, we recommend discussing your requirements with us before ordering.

14. Product Care & Storage

14.1

Many of our products are decorative in nature and should be handled with reasonable care.

14.2

Unless specifically stated otherwise, printed ribbons should be handled with clean, dry hands.

Some print finishes, particularly lighter foil colours and fine-detail printing, may be more susceptible to wear through excessive handling.

14.3

Where ribbon is likely to be handled extensively, washed or exposed to moisture, alternative print finishes may be available.

Please contact us before ordering if this is important to your application.

14.4

For best results we recommend storing ribbon:

  • away from direct sunlight;
  • in a cool, dry environment;
  • below approximately 20°C where practical;
  • away from excessive humidity.

14.5

Prolonged exposure to ultraviolet light, heat, moisture or harsh environmental conditions may affect the appearance and lifespan of decorative ribbon products.

15. Delivery

15.1

Orders are dispatched using the carrier most appropriate for the size, weight and destination of the parcel.

This may include:

  • APC Overnight
  • DPD
  • DHL
  • Royal Mail
  • specialist courier services

or other carefully selected delivery partners.

15.2

Delivery estimates are provided in good faith but are not guaranteed.

Whilst we make every reasonable effort to dispatch goods on time, we cannot accept responsibility for delays caused by courier networks, adverse weather, customs procedures, traffic disruption or other circumstances outside our reasonable control.

15.3

Time shall not normally be of the essence unless expressly agreed by us in writing before the order is accepted.

15.4

Customers are responsible for ensuring that someone is available to receive deliveries where a signature is required.

Additional delivery charges arising from failed delivery attempts or incorrect delivery information may be payable.

15.5

Where tracking information is available, it is your responsibility to monitor the delivery progress and make appropriate arrangements with the courier where necessary.

16. Delivery Delays

16.1

If your order has not arrived within the estimated delivery period, please contact us as soon as possible.

We will investigate the matter with the delivery carrier on your behalf.

16.2

Lost parcel investigations are carried out in accordance with the procedures of the relevant delivery company.

Replacement goods or refunds will normally only be considered once the carrier has confirmed that a parcel has been lost.

16.3

We cannot accept liability for consequential losses arising from delivery delays, including but not limited to:

  • postponed ceremonies;
  • delayed product launches;
  • missed promotional events;
  • venue costs;
  • contractor costs;
  • travel expenses;
  • loss of business;
  • loss of profits.

Nothing in this clause affects your statutory rights.

17. Inspection of Goods

17.1

Please inspect your order as soon as reasonably possible after delivery.

17.2

Any shortages, transit damage or manufacturing concerns should normally be reported to us within 48 hours of delivery.

Prompt notification allows us to investigate efficiently and resolve matters quickly.

17.3

Where damage is believed to have occurred during transit, we may ask you to provide:

  • photographs of the packaging;
  • photographs of the damaged goods;
  • details of the courier label;
  • any other reasonable information required to assist our investigation.

17.4

Please retain all original packaging until any investigation has been completed.

18. Faulty, Incorrect or Damaged Goods

18.1

If we have supplied goods which are faulty, damaged before delivery or materially different from your confirmed order, please contact us as soon as possible.

18.2

Where appropriate we may, at our discretion:

  • repair the goods;
  • replace the goods;
  • reprint the goods;
  • offer a partial refund;
  • offer a full refund.

The appropriate remedy will depend upon the circumstances of each case and your statutory rights.

18.3

We reserve the right to inspect or request the return of goods before determining the appropriate resolution.

Where return is required, reasonable return postage costs will be reimbursed where the goods are confirmed to be faulty or supplied in error.

19. Returns

19.1 Personalised Products

As most of our personalised products are manufactured specifically to your individual requirements, they cannot normally be cancelled or returned once production has commenced.

This reflects the exemption for personalised goods under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

19.2 Standard Stock Products

Where goods are not personalised and are suitable for resale, consumers may have the right to cancel and return their purchase within the statutory cancellation period, provided that:

  • the goods remain unused;
  • they are returned in their original condition;
  • they are suitable for resale;
  • they are returned with original packaging where reasonably possible.

19.3

Nothing within these Terms affects your statutory rights as a consumer.

20. Cancellation

20.1

Orders for personalised goods enter production shortly after artwork approval.

For this reason, cancellation may not be possible once production has commenced.

20.2

If you need to amend or cancel an order, please contact us immediately.

Where production has not yet started, we will always do our best to accommodate your request.

20.3

Where design work has already been completed prior to cancellation, we reserve the right to make a reasonable charge for work undertaken where this has previously been communicated.

21. Ownership and Risk

21.1

Ownership of all goods shall remain with Fun in a Box Limited until payment has been received in full.

21.2

Risk in the goods passes to you upon delivery or collection.

21.3

Until ownership has passed, you shall not sell, pledge or otherwise dispose of the goods in a manner inconsistent with our ownership rights.

22. Business Customers

22.1

Business customers are responsible for ensuring that products ordered are suitable for resale or their intended commercial application.

22.2

Business customers should satisfy themselves regarding specifications, colours, dimensions and suitability before placing large-volume orders.

Where appropriate, we recommend ordering samples in advance.

22.3

Where products are incorporated into other goods or supplied onward to third parties, responsibility for that onward use rests with the business customer.

22.4

Nothing in these Terms excludes liability that cannot legally be excluded under the laws of England and Wales.

23. Intellectual Property

23.1

Unless otherwise agreed in writing, all artwork, product photographs, website content, product descriptions, graphics, logos, designs, layouts, software, documents and other material created by Fun in a Box Limited remain our intellectual property.

Nothing within these Terms transfers ownership of our intellectual property rights.

23.2

Where artwork has been supplied by you, ownership of that artwork remains with you or the relevant copyright owner.

You grant Fun in a Box Limited permission to reproduce that artwork solely for the purpose of manufacturing and supplying your order unless otherwise agreed.

23.3

We reserve the right to refuse to reproduce any artwork which we reasonably believe infringes copyright, trademarks or other intellectual property rights.

23.4

You agree to indemnify and hold harmless Fun in a Box Limited against any claim, loss, damage or expense arising from artwork supplied by you which infringes the rights of another party.

24. Photography & Portfolio Use

We are proud of the products we create and occasionally photograph completed work for use within our portfolio.

24.1

Unless you advise us otherwise before production begins, we may photograph or film products manufactured by us for use on:

  • our websites;
  • social media;
  • brochures;
  • catalogues;
  • advertising;
  • exhibitions;
  • marketing material.

24.2

Where practical, we aim to avoid displaying personal information unnecessarily.

24.3

If you would prefer your order not to be photographed or published, simply let us know before production begins and we will happily respect your wishes.

25. Customer Reviews

25.1

Following completion of your order, we may invite you to leave a review regarding your experience.

25.2

Review invitations may be sent by email or through recognised independent review platforms.

25.3

You are under no obligation to provide a review and may unsubscribe from future review requests at any time.

26. Website Information

26.1

We make every reasonable effort to ensure that information contained on our websites is accurate and up to date.

26.2

Product descriptions, photographs, specifications and prices may occasionally change without notice.

26.3

Minor typographical errors, website inaccuracies or pricing mistakes may occasionally occur.

Where an obvious error has affected your order, we reserve the right to cancel the order before production begins and will offer either:

  • a full refund; or
  • the opportunity to proceed at the correct price.

26.4

Availability shown on our websites should not be interpreted as a guarantee that products or materials remain continuously in stock.

27. Limitation of Liability

Nothing within these Terms excludes or limits liability where it would be unlawful to do so.

27.1

Subject to your statutory rights, our total liability arising from any order shall not exceed the purchase price paid for the relevant goods.

27.2

We shall not be liable for indirect or consequential losses including, but not limited to:

  • loss of profits;
  • loss of business;
  • loss of contracts;
  • loss of anticipated savings;
  • loss of goodwill;
  • missed ceremonies;
  • delayed product launches;
  • postponed events;
  • venue costs;
  • contractor costs;
  • third-party expenses;
  • travel expenses;
  • accommodation costs.

27.3

Decorative ribbons and bows are supplied for decorative purposes.

It is your responsibility to determine whether a particular product is suitable for your intended application.

27.4

Nothing within these Terms excludes liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • any liability which cannot legally be excluded under the laws of England and Wales.

28. Goodwill

From time to time, Fun in a Box Limited may choose to offer goodwill gestures including, but not limited to:

  • replacement products;
  • discounts;
  • vouchers;
  • expedited production;
  • upgraded delivery services;
  • partial refunds.

Such gestures are offered entirely at our discretion.

The provision of goodwill on one occasion shall not create any obligation or expectation that similar goodwill will be offered in future circumstances.

29. Force Majeure

29.1

We shall not be liable for any failure or delay in performing our obligations where such delay results from circumstances beyond our reasonable control.

These may include, but are not limited to:

  • severe weather;
  • flooding;
  • fire;
  • power failures;
  • internet outages;
  • cyber attacks;
  • ransomware incidents;
  • supplier delays;
  • shortages of raw materials;
  • industrial disputes;
  • transport disruption;
  • customs delays;
  • pandemics;
  • government restrictions;
  • acts of terrorism;
  • war;
  • civil unrest;
  • other events outside our reasonable control.

29.2

Where such circumstances occur, we shall use reasonable endeavours to minimise any disruption and resume normal performance as soon as reasonably practicable.

30. Privacy & Data Protection

We are committed to protecting your privacy.

Any personal information collected by us will be processed in accordance with:

  • UK General Data Protection Regulation (UK GDPR);
  • the Data Protection Act 2018;
  • our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and protect your personal information.

31. Electronic Communications

31.1

By placing an order with us, you agree that we may communicate with you electronically where appropriate.

This may include:

  • order confirmations;
  • artwork proofs;
  • dispatch notifications;
  • invoices;
  • delivery updates;
  • customer service correspondence.

31.2

Emails sent to the address provided by you shall be deemed received unless we become aware of a delivery failure.

It is your responsibility to ensure that your email address is accurate and to check spam or junk folders where necessary.

32. Severability

If any provision of these Terms is found by a court to be unlawful, invalid or unenforceable, the remaining provisions shall continue in full force and effect.

33. Waiver

If we choose not to enforce any provision of these Terms on one occasion, this shall not prevent us from enforcing that provision or any other provision in future.

34. Entire Agreement

These Terms, together with any quotation, order confirmation and the documents referred to within them, constitute the entire agreement between you and Fun in a Box Limited relating to the sale of goods.

No verbal statement or representation shall form part of the contract unless confirmed by us in writing.

35. Changes to these Terms

We reserve the right to update these Terms from time to time.

The version published on our website at the time an order is placed shall apply to that order.

36. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
